If you do not agree to these terms, do not use the App. You must be at least 18 years old to use this App. By using the App, you represent and warrant that you are at least 18 years of age.

AccountabiliBuddy is a commitment tracking and accountability tool that:

• Connects you with an accountability buddy via shared pact codes
• Tracks your commitments and progress
• Displays penalty calculations based on missed sessions
• Facilitates communication between pact partners

This App is NOT a gambling service, payment processor, or financial services platform. The App simply displays suggested penalty amounts based on user-defined parameters. Users are under no legal obligation to pay these amounts, and the App has no mechanism to enforce, collect, or process any payments.

THIS IS CRITICAL TO UNDERSTAND:

• We do not process, store, or handle any payments whatsoever
• We do not collect any payment information (no credit cards, bank accounts, or payment credentials)
• We do not facilitate money transfers - Any payments between users occur entirely outside our platform using third-party services
• We have no ability to enforce payment - Penalty amounts shown are suggestions only
• We are not a party to any financial arrangement between you and your pact partner
• We bear no responsibility for any money exchanged or not exchanged between users

Any financial stakes or "bets" referenced in the App are purely motivational tools agreed upon privately between users. The App simply tracks and displays these user-defined amounts but has no involvement in actual monetary transactions.

IMPORTANT: Read this carefully before using the App.

• Consult a physician before starting any new health or fitness routine. This is especially important if you have any medical conditions, injuries, or health concerns.
• We are not medical professionals - The App does not provide medical advice, diagnosis, or treatment.
• Participate at your own risk - Some commitments involve physical activity which carries inherent risks including injury, disability, or death.
• Listen to your body - Stop any physical activity immediately if you feel pain, dizziness, or discomfort.
• We are not responsible for injuries - Any injuries sustained during activities are your sole responsibility.

By using the App, you acknowledge that you are voluntarily participating in activities related to your commitments and assume all risks associated with such activities.

user responsibilities.

By using AccountabiliBuddy, you agree to:

• Be at least 18 years of age
• Provide accurate information about yourself
• Only enter pacts with people you personally know and trust
• Take full responsibility for any private agreements made with your pact partner
• Not use the App for harassment, abuse, fraud, or any illegal purpose
• Not attempt to exploit, hack, or misuse the App
• Comply with all applicable local, state, national, and international laws

pact agreements between users.

When you create or join a pact:

• The agreement is entirely between you and your pact partner - AccountabiliBuddy is not a party to this agreement
• We cannot mediate disputes - Any disagreements between pact partners must be resolved between yourselves
• We cannot enforce agreements - We have no legal authority or mechanism to enforce any commitments
• Penalty amounts are suggestions only - Users are not legally obligated to pay
• Either party may end a pact at any time through the App

content & conduct.

You are solely responsible for:

• Any content you share through or in connection with the App (including selfies shared via messaging apps)
• Your interactions with other users
• Ensuring your use of the App complies with all applicable laws

limitation of liability.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
• We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages
• We are not liable for any physical injuries, health issues, or death resulting from exercise
• We are not liable for any financial losses or disputes between users
• We are not liable for service interruptions, data loss, or technical issues
• Our total liability shall not exceed the amount you paid to use the App (which is zero, as the App is free)

indemnification.

You agree to indemnify, defend, and hold harmless AccountabiliBuddy, its owners, operators, affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Any dispute between you and another user
• Any physical injury or health issue related to exercise activities

governing law & disputes.

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

termination.

We reserve the right to terminate or suspend your access to the App at any time, for any reason, without notice. Upon termination, your right to use the App will immediately cease.

changes to terms.

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

severability.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
